ChemCert seeks stay of registration decision

CHEMICAL-USE training group ChemCert has applied to the Administrative Appeals Tribunal (AAT) to review the expiry of its registration with the Australian Skills Quality Authority.

Last week, Grain Central reported that ChemCert had declared it was unable to deliver accredited courses, enrol new students nor issue certification to those who have completed units.

ChemCert chief executive officer Brian Halse has refused to comment on ChemCert’s status, but on the Australian Government’s www.training.gov.au website, the ChemCert Training Group Pty Ltd’s registration period with the registration manager, the Australian Skills Quality Authority (ASQA), is listed as expired as of 23 January this year.

An ASQA statement has also confirmed that ChemCert’s registration period expired on 23 January 2019.

“In accordance with Section 31 of the NVR Act, registered training organisations are required to submit an application for renewal at least 90 days before registration expires; or within such shorter period as the regulator allows,” ASQA said.

“On 23 September 2018, Chemcert was sent a reminder to submit a renewal of registration application. ChemCert failed to submit the renewal application within the required timeframe.

“On 17 December 2018 the Australian Skills Quality Authority (ASQA) notified Chemcert of the decision that ASQA was not allowing a shorter period for Chemcert to apply for renewal of registration.”

The ASQA statement said ChemCert had applied to the Administrative Appeals Tribunal for a review of ASQA’s decision. ChemCert has also applied for a stay of ASQA’s decision. The matter is currently before the AAT, ASQA said.
